The shape of things to come with the Charity Tribunal?
The Scottish Charity Appeals Panel (SCAP) published its first written judgment on 26 March 2008, upholding an earlier decision of The Office of the Scottish Charity Regulator (OSCR).
The Aberdeen Mosque and Islamic Centre (SC038010) was required to change its name on grounds there was already a charity with the same name on the Charity Register (SC028038), with according to SCAP ‘better title to the name’. The appellants (SC038) had appealed upon various grounds, including that OSCR’s process had been unfair and that the other charity (SC028) should have been told to make the name change. Although the panel confirmed OSCR’s view on all substantive points, it did make suggestions for improvements in its processes.
OSCR’s CEO Jane Ryder commented ‘this demonstrates that the appeals process is thorough, robust and can address the concerns of both the appellant and OSCR’.
