Never forever CIOs?
Unsurprisingly, the implementation of the Charitable Incorporated Organisation (‘CIO’), the new legal structure specifically designed for charities, has been delayed
until the autumn. In the end there was no time for the secondary legislation needed to implement the CIO to be put to Parliament during the last session. So this means that the CIO will not be available until the latter part of 2010 or early in 2011.
The broad framework for CIOs was set out in the Charities Act 2006. A consultation on proposed secondary legislation was undertaken in December 2008 and a
joint Cabinet Office/Charity Commission response was published in September 2009. It was previously expected that CIOs would become available by early 2010.
