The Charity Commission recently released draft guidance on public benefit and the prevention or relief of poverty, and the advancement of religion. The sector has been asked for its views on this draft guidance by way of consultation. This article looks at some of the main issues arising from this guidance, and highlights areas of potential difficulty for charities who operate in these areas.

Robert Meakin is a solicitor and was also previously at the Charity Commission. He is an advisory board member of the European Association for Planned Giving, a member of the Charity Law Association and Charifaith CIF. He conducts regular seminars on charity law and practice. Robert has recently been awarded a PhD in charity law by the University of Liverpool
