Cabinet office publishes guidance to fundraising statements
The Cabinet Office has now published draft guidance to help professional fundraisers and retailers who raise money for charity through sales to comply with the new laws.
Currently, professional fundraisers and commercial participators are required to make statements but the new requirements are much clearer about what they must contain. Although there is a lot of goodwill in the sector about the need for transparency in fundraising costs, more clarification does appear to be necessary.
Rosamund McCarthy of law firm Bates Wells and Braithwaite LLP told Caritas magazine ‘I do think the guidance is helpful in some respects but there are still some unanswered questions. For example, if a professional fundraiser works on a freelance basis, should there be dual disclosure – i.e. their individual costs and the costs of the fundraising organisation they are acting for?’
