Macfarlanes charity group provides a comprehensive service to its clients. We give detailed advice to charities on a broad range of matters. As well as providing direct assistance on matters of charity law, we also advise on commercial and property matters that impact on charities or their trading subsidiaries. This has included helping clients in relation to land transactions, licensing and intellectual property rights, and fundraising with commercial participators and professional fundraisers.
Typical work handled by the team includes advising and assisting on:
• the formation of charities and the most appropriate legal vehicle in each case;
• questions of charitable status;
• constitutional issues;
• charity mergers;
• Royal Charter advice;
• day-to-day administrative matters, including drafting minutes and attending meetings of charity trustees;
• trustee remuneration and tax.
As well as having an in-depth understanding of the legal technicalities of charity work, however, the group is also highly experienced at providing commercial advice on the many business issues facing modern charitable organisations, including:
• land transactions;
• licensing and intellectual property rights; and
• fundraising with commercial participators and professional fundraisers.
Our charity clients include Action Resource Centre, the J Paul Getty Jr General Charitable Trust, Portsmouth Naval Base Property Trust, the Lister Institute, the Fas Trust, the Federation of London Youth Clubs, National Missing Persons' Helpline, The Grenadier Guards Regimental Charities, The Household Division Regimental Charities, The Trusthouse Charitable Foundation and the Royal Academy of Arts.
